Event Waiver, Release of Liability and Indemnity Agreement
Children Believe Fundraiser Waiver/Terms and Conditions
As an individual or organization planning or participating in a fundraising event in support of Children Believe, I acknowledge and agree to the following terms:
1. Alignment with Mission, Values, and Guidelines
I agree that my event will align with Children Believe’s mission to remove barriers to education and support children and communities, and will reflect the organization’s values, brand standards, and reputation. I will adhere to all applicable Children Believe fundraising guidelines and policies, as well as all Canada Revenue Agency (CRA) rules and legal requirements governing charitable fundraising.
2. Independent Event Status
I understand that my fundraiser is independently organized and is not an official Children Believe event. All communications, promotions, and materials must clearly state that the event is “in support of Children Believe.”
Children Believe is not responsible for organizing, managing, or executing my event.
3. Assumption of Risk and Liability
I accept full responsibility for all aspects of my event, including planning, promotion, execution, and safety.
I understand and agree that:
- Children Believe assumes no liability for the event
- I assume all risks related to the event, including injury, loss, or damage
- Children Believe is not responsible for any claims, damages, expenses, or legal actions arising from my event
I agree to indemnify and hold harmless Children Believe, its staff, representatives, and affiliates from any liability connected to the event.
4. Insurance, Permits, and Legal Compliance
I am responsible for obtaining all required:
- Permits and licenses
- Insurance coverage
- Municipal, provincial, and federal approvals
I will ensure the event complies with all applicable laws and regulations, including safety requirements and risk management practices.
Children Believe may request proof of permits, insurance, or approvals at any time.
5. Financial Responsibility and Handling of Funds
I understand that:
- I am responsible for all event costs and expenses
- Children Believe will not fund, reimburse, or underwrite any part of the event
- No bank account may be opened in the name of Children Believe
All funds raised must be:
- Safeguarded appropriately
- Submitted to Children Believe within 30 days of the event
I will clearly communicate to participants the portion of proceeds being donated (percentage or fixed amount).
6. Tax Receipts and CRA Compliance
I understand and agree that Children Believe reserves the final decision to issue any official tax receipts, which, if so issued, must be in accordance with CRA guidelines.
I shall allow Children Believe or, at the direction of Children Believe, its authorized agent, to perform an audit, at Children Believe’s cost, of my compliance with the terms of this agreement as deemed necessary by Children Believe in its sole discretion.
I acknowledge that:
- Not all contributions qualify for tax receipts (e.g., event tickets, raffles, auction purchases)
- Children Believe has sole discretion over receipting eligibility
- All fundraising activities must comply with CRA regulations
7. Use of Name, Logo, and Branding
I agree that:
- The event must be clearly positioned as “in support of Children Believe”
- No materials bearing the “In Support of Children Believe” logo will be printed or displayed for the event without Children Believe’s prior approval All promotional materials must be reviewed and approved prior to distribution
- The official Children Believe logo by itself cannot be used for third party fundraising events
- Children Believe reserves the right to withdraw permission to use its name or brand at any time.
8. Privacy
I consent to the collection, use, transfer and disclosure of my personal and event donors’ information as described below:
- My personal information, as well as donors to my fundraiser, will be collected, used, and retained by Children Believe in accordance with applicable privacy laws and the organization’s privacy policy, including for purposes such as:
- Processing and receipting your donation
- Responding to donor inquiries
- Maintaining accurate financial and donor records
- Communicating with you about the impact of your gift and other opportunities to support the organization (you may opt out at any time)
- I knowingly and voluntarily agree to abide by Children Believe’s Privacy Policy as outlined in the Privacy page: https://childrenbelieve.ca/privacy
9. Marketing and Promotions
I will ensure that:
- All promotional activities comply with Canada’s Anti-Spam Legislation (CASL)
- No donor or supporter data from Children Believe is requested or used
- Children Believe will not be required to solicit sponsors, donors, or participants on my fundraiser’s behalf
10. Sponsorship and Event Associations
I agree that my event will not be associated with organizations, industries, or activities that could conflict with Children Believe’s mission, values, or reputation.
Children Believe reserves the right to determine whether any partnership or association is appropriate.
11. Lotteries, Raffles, and Gaming
If my event includes raffles, draws, or games of chance, I am responsible for:
- Obtaining all required licenses
- Ensuring compliance with provincial regulations
Children Believe must be notified in advance of any such activities.
12. Event Management Responsibilities
I acknowledge that I am fully responsible for:
- Planning and executing the event
- Recruiting volunteers and staff
- Securing venues and vendors
Children Believe:
- Will not sign contracts or agreements on behalf of the event
- Will not assume responsibility for event logistics or operations
13. Use of Images and Media
I grant permission to Children Believe to use photos, videos, or other media from the event for promotional, recognition, or reporting purposes in any format or media, without compensation.
14. Event Changes or Cancellation
I agree to promptly notify Children Believe if the event is:
- Cancelled
- Postponed
- Significantly changed
Children Believe reserves the right to withdraw its name and support at any time.
15. Multiple Beneficiaries
If my event supports additional organizations, I will disclose this in advance and clearly communicate how funds will be distributed.
16. Agreement and Acknowledgement
By clicking on the Waiver Acceptance button below, I confirm that I am at least 14 years old or older, and have read, understood, and agree to comply with these terms and conditions and all Children Believe fundraising guidelines. If I am under the age of 14, I confirm that I have obtained parental or guardian consent prior to registering my fundraiser and understand that Children Believe reserves the right to verify my age and parent consent if necessary. If I am acting on behalf of a corporation, I represent and warrant that I have the authority to bind the corporation.
